According to BetterRetailing news on December 7, UK retailers may now be fined for failing to set up a recycling program for portable vapes, and there is no upper limit on the amount of the fine.
The UK Office for Product Safety & Standards (OPSS) has increased the fine from the original £5,000 for retailers who fail to provide consumers with portable vape disposal options.

Retailers with annual sales of less than £100,000 of electronic products, including vapes, must join a scheme called the Marketer Take Back Scheme (DTS), with fees depending on the size of the store and sales.
Shop owners with annual sales of more than £100,000 must provide customers with a way to dispose of vapes in-store.
Waste Experts, on the other hand, offers vape waste containers to retailers for £168 a pop. Since the company launched the project in March, it has sold 1,000 of these waste containers, which Brosewood said was “not a huge number.” Retailers will be charged £165 each time they collect waste containers.
Broswood said: “Because under the DTS regulations, retailers need to pay for the logistics of vape collection, and the recycling process of vapes is expensive. There is currently a lot of legislative work going on in the background to reduce costs, but it still costs money. Very high cost.”
Some vape brands, such as Elux and ELFBAR, have also launched and funded free waste collection bins and collection services for use in stores.
