Malaysia’s Deputy Health Minister Datuk Lukanisman Awang Sauni said the government plans to treat vapes as traditional tobacco cigarettes in proposed regulations under the Public Health Smoking Products Control Act 2024 (Bill 852).

Lukanisman told parliament that the Ministry of Health was considering implementing plain (plain) packaging for traditional cigarettes and “standard packaging” for vape products. The Ministry of Health is also looking to restrict the flavors of vapes.

He added that the Ministry of Health is actively seeking input from other ministries and industry on the proposed regulations for the control of vapes under Bill 852.

However, Ridhwan Rosli, secretary-general of the Malaysian vape Chamber of Commerce, said the vape industry has not received any details on the proposed regulations that will be introduced for the industry.

“Earlier this year, the Ministry of Health held a consultation meeting with the vape industry but did not provide details on the regulatory framework for the vape industry,” he said. “At the time, we were told that discussions and studies were still ongoing at the Ministry of Health. We were very surprised when we saw news reports that the regulations had been drafted and were currently being evaluated by legal officials.”

He was referring to information stated by Health Minister Dr Dzulkefly Ahmad that he will submit a memorandum document on the proposed regulations of Bill 852 to the Cabinet. The bill has been gazetted and will coincide with the implementation of the regulations.

He added: “This matter should be taken seriously as the industry needs to have a transparent discussion about the proposed regulations and policies considered by the Department of Health. As of now we do not know the details of the proposed regulations or whether it will Impacting the current operations of the industry.”
