According to Brazil’s Só Notícias report on October 18, Brazilian federal congressman Gisela Simona submitted a bill in Congress proposing to criminalize the sale, import, and advertising of vape devices as a public health crime.

The project stipulates that anyone selling, importing, providing or advertising vape devices shall be punished with a prison sentence of 2 to 4 years and a fine of 300 to 1,000 days. If a minor is involved, the sentence will be increased to 4 to 8 years and a fine of 500 to 1,500 days will be paid.

Simona further proposed that Brazil’s National Health Surveillance Agency (Anvisa), responsible for protecting public health, clarify that this agency has the authority to regulate the testing and registration process of vape devices and analyze relevant studies submitted in administrative procedures. She emphasized that the role of public agencies within the national consumer protection system or the national health supervision system is the regulation of vape devices.

“The work of the government in the administrative field cannot be ignored, and the powers of the national police must be fully used to protect the public from the risks of vapes.” Simone warned.

She stressed that this proposal protects the best interests of every Brazilian citizen, namely their health, which is now threatened by legal loopholes in the use of vapes. She reminded people that the most famous example is Law 9.294 of 1996, which restricts the consumption and advertising of tobacco products. The results in the fight against smoking are remarkable.

This proposal put forward by Brazilian lawmakers means that vapes face more stringent supervision and restrictions.
